Three neighbouring towns, three different administrative arrangements, and none of them is Union County's default.
These towns are Union County rather than Mecklenburg, which means none of the Charlotte or Mecklenburg material elsewhere on this site applies to them. They also differ from each other. Building permits and stormwater do not follow the same map, and Waxhaw is unlike its two neighbours on both counts.
Which drainage rules apply
All three of these towns sit outside Union County's zoning jurisdiction, and they do not share one arrangement. Here it is town by town.
Waxhaw: issues its own building permits; administers its own stormwater. Holds delegated erosion and sedimentation authority from the NC Sedimentation Control Commission.
Weddington: building permits go through Union County; administers its own stormwater. Runs its own planning and zoning permitting portal.
Indian Trail: building permits go through Union County; administers its own stormwater. A stormwater Phase II community since 2005, with its own SCM maintenance requirements.
What this means for your gutters
Larger lots and mature trees are the practical drivers out here, and on properties with well or septic systems the discharge point of a downspout matters more than it does on a compact lot in the city. For routine cleaning none of the administrative differences matter. They start to matter as soon as work moves a discharge point or disturbs ground, and at that point knowing which office governs is the difference between a straightforward job and a stalled one.
Waxhaw is the outlier. Its Building Inspections division sits inside the town's own Planning and Inspections department and administers the North Carolina building codes directly, with a town Chief Building Inspector. Its stormwater requirements are in Chapter 9 of the town's Land Development Code, and the town holds delegated erosion and sedimentation authority from the NC Sedimentation Control Commission. In practice that means Waxhaw answers for itself on essentially everything.
Indian Trail runs its own stormwater programme and has been a Phase II community since 2005, with its own maintenance requirements for stormwater control measures inside town limits. Building permits, though, go through Union County.
Weddington also uses Union County for building permits while operating its own planning and zoning permitting portal.
All three sit outside Union County's zoning jurisdiction, which is a list of thirteen municipalities rather than the two that commonly gets repeated. Building code enforcement and zoning follow different maps here, and conflating them is the usual source of wrong information about this part of the county.
What the properties themselves need. Larger lots mean discharge generally has somewhere to go, which removes the commonest urban failure. What replaces it is distance - long runs on substantial roofs, where the question is how far water travels to reach an outlet rather than whether the trough is clear. Where a property is on well or septic, the discharge point matters rather more than it does on a compact lot.
