What the rules actually say

Homeowners often assume Charlotte has a rule about where a downspout may discharge. Read the city's stormwater ordinance and it does not, because that ordinance governs non-stormwater discharges - things that are not rain. Roof runoff is stormwater by definition, so it never enters that scheme. What the ordinance does address is worth knowing: it expressly permits discharge from foundation drains, footing drains and crawl space pumps. If you are tying a sump line in near a downspout, that is the provision that covers it. Where water goes relative to a neighbour is a separate question, and it is a civil one between owners rather than something the city ordinance decides.

Extensions and why they get removed

An extension that discharges a few feet from the wall is doing the job the downspout could not. They get pulled off for mowing and never replaced, which is why we look for the disconnected one on nearly every visit.

Downspouts are usually the real bottleneck

Most attention goes to the trough, but the trough is a reservoir and the downspout is the drain. Sizing the gutter up while leaving the outlets alone moves the constriction rather than removing it. The plumbing code's own figures make the point. A 5-inch gutter is rated at 74 gallons per minute and a 6-inch at 110, while a 2-inch vertical drain carries 34 and a 3-inch 87. A large gutter emptying through one small outlet cannot deliver what it collects, and the surplus goes over the front edge.

One caveat we would rather state than gloss: those code figures are for round pipe, and the 2x3 and 3x4 rectangular downspouts actually fitted to houses are not in that table. Treating them as equivalent to a round size is an inference, so we use the figures to reason about the shape of the problem rather than to quote a precise capacity.

Adding a downspout is often the cheapest real fix

Where a long run overflows at one end, the useful question is usually not what size the gutter is but how far water has to travel to reach an outlet. Splitting that distance with a second downspout halves the load on each and costs a fraction of re-running the gutter. It is also the fix most often overlooked, because it does not involve replacing anything visible.

That each downspout is actually connected at the top, that nothing is crushed or kinked along its length, that the outlet at the gutter is clear rather than packed, and that whatever receives the water at the bottom can take it.

How far from the house should water discharge?

Far enough that it is not soaking the foundation perimeter. The right distance depends on grade, which is why we look rather than quote a number.

Can a downspout tie into the storm drain?

Roof runoff is stormwater, so it is not an illicit discharge. Whether a particular connection is practical is a separate question about the pipe, not the rule.
